This page sets out the limits of our liability and your indemnity when you use mybathrobe.net or buy from Bathrobe Company Canada, a division of Caruso Consulting Co Ltd. It forms part of our Terms & Conditions.

Your rights come first

Nothing on this page limits or excludes a liability that the law does not allow us to limit or exclude. That includes your rights under the consumer protection and sale of goods laws of your province or territory, and liability for fraud or for injury caused by our negligence. Where those rights apply, they take priority over everything below.

Limits on our liability

Subject to the section above, and as far as the law allows:

• we are not liable for indirect or consequential losses, or for lost profits, revenue or data;
• we are not liable for loss that was not foreseeable, or that was caused by misuse of a product, by not following its care instructions, or by normal wear and tear;
• where we are liable for a loss connected with an order, our total liability is limited to what you paid for the products in that order.

Shipping delays

We work to ship on time and to tell you if something changes. If an order is delayed, your rights are set out on our Refunds & Returns page, including your right to cancel and be refunded before it ships.

Website availability

We try to keep the site available and working, but we cannot promise it will never be down or error free. We may change or pause parts of it without notice.

Your indemnity

You agree to cover reasonable losses and costs we incur because you broke our Terms & Conditions, misused the site, or infringed someone else's rights through your use of it.
